Terms of Service

Effective date: August 10, 2026

These are the ground rules for using WhoseNight. We have kept them short and in plain language, because that is how we build everything.

What WhoseNight is

WhoseNight is a custody calendar app for co-parents. It answers one question at a glance: whose night is it? By downloading or using the app, you agree to these terms. If you do not agree, please do not use the app.

The free app and WhoseNight Family

The core app is free. One optional upgrade, WhoseNight Family, unlocks additional features (such as the Live Shared Calendar) for your whole family under a single subscription.

WhoseNight Family is billed through Apple's App Store as an auto-renewing subscription. Pricing is shown in the app before you buy. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it anytime in your App Store account settings. Refunds are handled by Apple under Apple's policies.

Your content stays yours

Everything you put into WhoseNight, including schedules, labels, names, and notes, belongs to you. We claim no ownership of it. Most of it never leaves your device at all, as described in our Privacy Policy.

WhoseNight is a planning tool, not a legal record

WhoseNight helps amicable co-parents keep track of their schedule. It is not legal advice, it is not an official record of custody arrangements, and it is not designed or intended for use as evidence in any legal proceeding. Your custody agreement or court order, not the app, is the authority on your arrangement.

Ground rules

Please use WhoseNight only for its intended purpose. You agree not to attempt to break, overload, reverse engineer, or gain unauthorized access to the app or its services, and not to use shared calendar links to harass anyone or to publish content you have no right to share.

Shared calendar links

If you enable the Live Shared Calendar, you are responsible for who you give the link to. Anyone with the link can view the calendar content you chose to publish. You can turn sharing off at any time, which removes the calendar from our server.

The service, as is

We work hard to keep WhoseNight reliable, but the app and its services are provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee the app will always be available, error-free, or uninterrupted.

Limits on our liability

To the fullest extent permitted by law, WhoseNight and its creator are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid us in the twelve months before the claim arose.

Ending things

You can stop using WhoseNight at any time by deleting the app. We may suspend or end access to the shared calendar service for accounts that violate these terms.

Changes to these terms

If we make meaningful changes to these terms, we will update the effective date at the top of this page. Continuing to use the app after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
